On February 17, 2026, Judge Jed Rakoff of the Southern District of New York issued a ruling that changed the landscape for AI in legal practice. In United States v. Heppner, the court held that documents generated using a consumer AI platform were protected by neither attorney-client privilege nor the work product doctrine.
The reasoning was straightforward: when you type a prompt into a cloud AI service, you are disclosing information to a third party. That third party’s Terms of Service permit data collection, model training, and disclosure to government authorities. There is no reasonable expectation of confidentiality. And without confidentiality, there is no privilege.
We saw a gap. Law firms need AI to remain competitive. But the tools available require sending sensitive client data to someone else’s servers. After Heppner, that’s not just a policy concern — it’s a privilege waiver risk.
